The Legislation in Australia only

Since October 1, 2021, there has been a significant change in handling Nicotine-based products in Australia.

Authorised Prescriber

27 June 2022

The Authorised Prescriber Scheme allows authorised medical practitioners to supply therapeutic goods (such as medicines, medical devices or biologicals) that are not included in the Australian Register of Therapeutic Goods (ARTG) to a class of patients with a particular medical condition.

An Authorised Prescriber can supply the product directly to specified patients under their immediate care without requiring separate approval for individual patients.

Authorised Prescribers must report the number of patients treated every 6 months. Use of the product must be reported twice yearly, covering each period between 1 January to 30 June and 1 July to 31 December. Reporting through the SAS & Authorised Prescriber Online System is preferred.

Applying through the online system

Please submit your Authorised Prescriber application through the Special Access Scheme (SAS) and Authorised Prescriber Online System to reduce processing times.

Pharmacy

No nicotine vaping products are currently approved by the Therapeutic Goods Administration (TGA) registered in the Australian Register of Therapeutic Goods (ARTG). Medicines not in the ARTG are known as 'unapproved' medicines. Nicotine has been deemed a Poisonous substance and added to schedule 4 on the poison register. It is now only available to purchase via prescription through Dispensaries and Pharmacies in Australia.

We can supply you with any of the products listed on our website through next-day delivery and will accept small orders. Pharmacies purchasing nicotine vaping products from our site for their business to dispense to customers do not require a licence where they are subject to certain exemptions under state and territory law.

Wholesale

Currently, in Australia, there is no ability [unless you hold a licence to store Prescription medicine in controlled conditions] to lawfully wholesale nicotine-based products in Australia.

On 1 October 2021, the entry for nicotine in Schedule 4 to the Poisons Standard was amended so that it now captures all nicotine-based vaping products as prescription-only medicines.

It is now illegal for consumers to import nicotine vaping products from overseas websites without a valid prescription from an Australian doctor. Consumers continue to require a valid doctor's prescription to purchase nicotine vaping products from Australian pharmacies.

It was, and remains, illegal for other Australian retailers (such as tobacconists, 'vape' shops or convenience stores) or sell out of garages, back sheds, car boots, schoolyard toilets, handbags and bins to consumers, even if the consumer has a valid doctor's prescription.

There are currently no TGA-approved nicotine vaping products in the Australian Register of Therapeutic Goods (ARTG). Medicines not included in the ARTG are known as 'unapproved' medicines. There are established pathways for consumers to access unapproved nicotine vaping products with valid prescription legally, but these medicines have not been assessed by the TGA for safety, quality and efficacy.

Effectively this makes it almost impossible to operate a Wholesale business in Australia unless you have a State issued permit to warehouse schedule 4 poisons in temperature/humidity secure controlled environments.
